IM rendeiete a Szabadalmi Együttműködési Szerződéshez csatolt Végrehajtási Szabályzat szövegének kihirdetéséről l.§ Az igazságügy-miniszter a Szabadalmi Együttműködési Szerződés kihirdetéséről szóló, módosított 1980. évi 14. törvényerejű rendelet 5. §-ának (1) bekezdésében kapott felhatalmazás alapján a Szabadalmi Együttműködési Szerződéshez csatolt Végrehajtási Szabályzat — 1970. június 19-én elfogadott és a Szabadalmi Együttműködési Szerződés Közgyűlésének 1978. április 14-én, 1978. október 3-án, 1979. május 1-jén, 1980. június 16-án, 1980. szeptember 26-án, 1981. július 3-án, 1982. szeptember 10-én, 1983. október 4-én, 1984. február 3-án, 1984. szeptember 28-án, 1985. október 1-jén, 1991. július 12-én, 1991. október 2-án, 1992. szeptember 29-én, 1993. szeptember 29-én, 1995. október 3-án, 1997. október 1-jén, 1998. szeptember 15-én, 1999. szeptember 29-én, 2000. március 17-én, 2000. október 3-án, 2001. október 3-án és 2002. október 1-jén kelt határozataival módosított — 2003. január 1-jén hatályos, egységes szerkezetbe foglalt szövegét e rendelettel kihirdeti. 2. § A Szabadalmi Együttműködési Szerződéshez csatolt Végrehajtási Szabályzat angol nyelvű szövege és hivatalos magyar nyelvű fordítása a következő: „Regulations Under the Patent Cooperation Treaty PART A INTRODUCTORY RULES Rule 1 Abbreviated Expressions 1.1 Meaning of Abbreviated Expressions a) In these Regulations, the word „Treaty” means the Patent Cooperation Treaty. b) In these Regulations, the words „Chapter” and „Article”- refer to the specified Chapter or Article of the Treaty. Rule 2 Interpretation of Certain Words 2.1 „Applicant” Whenever the word „applicant” is used, it shall be construed as meaning also the agent or other representative of the applicant, except where the contrary clearly follows from the wording or the nature of the provision, or the context in which the word is used, such as, in particular, where the provision refers to the residence or nationality of the applicant. 2.2 „Agent” Whenever the word „agent” is used, it shall be construed as meaning an agent appointed under Rule 90.1, unless the contrary clearly follows from the wording or the nature of the provision, or the context in which the word is used. 2.2bis „Common Representative” Whenever the expression „common representative” is used, it shall be construed as meaning an applicant appointed as, or considered to be, the common representative under Rule 90.2. 2.3 „Signature” Whenever the word „signature” is used, it shall* be understood that, if the national law applied by the receiving Office or the competent International Searching or Preliminary Examining Authority requires the use of a seal instead of a signature, the word, for the purposes of that Office or Authority, shall mean seal. PART B RULES CONCERNING CHAPTER I Of/THE TREATY Rule 3 The Request (Form) 3.1 Form of Request The request shall be made on a printed form or be presented as a computer print-out. 3.2 Availability of Forms Copies of the printed form shall be furnished free of charge to the applicants by the receiving Office, or, if the receiving Office so desires, by the International Bureau.
